This course will provide delegates with the required knowledge for the professional presentation of the evidence in witness statements and prosecution files.

Witness Statement Writing section covers:

  • What constitutes evidence and its admissibility?
  • The rules relating to ‘hearsay evidence’.
  • The rules relating to ‘business document evidence’, and how to cover it correctly within a statement.
  • The rules of evidence re witness statements.
  • What is an exhibit? Dealing with its continuity, and how to produce them correctly in line with the legislation.
  • Planning prior to writing a statement.
  • The structure required to produce a quality statement.
  • Linking the contents to the records retained throughout the investigation.
  • The difference between producing a statement on behalf of the organisation, such as a statement of complaint, and individual testimony.
  • Identity evidence and how it should be included (R v Turnbull).
  • Court procedures re the use of witness statements.
  • Consequences of getting it wrong.

Case File Preparation section covers:

  • The types of cases and their respective court.
  • National File Standards, recognise what documents are required to complete the various types of files.
  • The difference between guilty and not guilty court files.
  • Ensuring the points to prove are covered within the contents of the prosecution file.
  • Examine the role of the Disclosure Officer with regard to completing the disclosure forms under CPIA.
  • What is required to complete a Disclosure Officer’s Statement.
  • The role of the Disclosure Officer following the completion and submission of a prosecution file.
  • The requirements for producing concise and accurate case summaries of the facts.
  • Dealing with witness and exhibit lists within a file.
  • Quality check prior to submission.
