CPIA Training/Refresher Training

 

The Criminal Procedures Investigations Act (CPIA) sets out what a criminal investigation is, the roles and responsibilities of those involved throughout the investigation.  It covers what should be recorded and how, the statutory disclosure regime as to what should be disclosed to the defence.

In the last few years there have been major changes to the Criminal Procedures Investigations Act (CPIA) investigation and disclosure requirements. The latest guidelines being implanted July 2022.  This training session will inform untrained staff and refresh currently trained staff on the current requirements in what is the most important legislation/codes of practice involved with regulatory/enforcement/criminal investigation functions.

 

This course will enable you to

Understand:

The requirements of CPIA

Set out what it is that the law requires.
Roles and Responsibilities and definitions.

CPIA during the investigation, what is expected?

CPIA from the beginning of the case, what is expected?

Joint working responsibilities.
Disclosure strategies.
Reasonable lines of enquiry and the balance with privacy.
Relevance test.
Prosecution disclosure test.
Third party material.
Managing material throughout the case.
Investigation and policy log and its relevance.
Engagement with the Prosecuting Solicitor.

The Statutory Disclosure Scheme and how it operates.

Pre-charge engagement.
Revealing material to prosecutor, relevance test, correct forms, content and certification.
Common Law disclosure test and prosecution disclosure test.
The presumption that certain material will meet the disclosure test and what this will mean in practice.
Disclosure management document.
Defence Statements and ongoing disclosure requirement

Who is the Course aimed at

Any person involved with enforcement/regulatory duties or in conducting or managing any aspect of criminal investigations. Can be used as refresher training. This is up to date in line with current guidelines issued July 22.
